These Terms and Conditions (the “Terms”) govern your use of the website omarham.org and your participation in any program, event, retreat, camp, workshop, session, or other activity (collectively, “Programs”) offered by Om Arham Foundation Inc., a California-registered 501(c)(3) public charity (EIN 41‑4122892) (“Om Arham Foundation,” “we,” “us,” or “our”).

By using our website, registering for, or participating in any Program (whether free or paid), you agree to be bound by these Terms. If you do not agree, please do not use the website or participate in our Programs.

1. About Our Programs

Om Arham Foundation offers Programs grounded in Arham Dhyan Yog and related contemplative practices, including online sessions, multi-day shivirs and retreats, seasonal camps, corporate engagements, and bootcamp workshops. Some Programs are free; others require payment of a fee or contribution. These Terms apply to all Programs, regardless of whether a fee is charged.

2. Eligibility and Registration

  • You must be at least 18 years old to register for adult Programs. Minors may participate only with the written consent of a parent or legal guardian, who accepts these Terms on the minor’s behalf.
  • You agree to provide accurate, current, and complete registration information and to update it as needed.
  • We may decline registration, limit attendance, or remove a participant at our discretion to protect the safety and integrity of the Program.

3. No Medical, Therapeutic, or Professional Advice

Our Programs are educational and contemplative in nature. They are not a substitute for medical, psychological, psychiatric, or other professional care, treatment, or diagnosis. Nothing provided by Om Arham Foundation, its facilitators, volunteers, or representatives constitutes medical advice, mental-health treatment, or therapy. You should consult a qualified healthcare professional before beginning any new physical or contemplative practice, particularly if you have any physical, mental, or emotional condition.

4. Health, Safety, and Assumption of Risk

You acknowledge and agree that participation in our Programs — including but not limited to meditation, breathwork, mindful movement, retreats, camps, and workshops — involves inherent physical, emotional, and psychological risks, including but not limited to:

  • Physical strain, soreness, or injury from movement, posture, or breathwork practices;
  • Emotional release, discomfort, or psychological distress;
  • Exposure to illness, allergens, or environmental conditions at in-person locations;
  • Travel-related risks for in-person retreats and camps.

You voluntarily assume all such risks. You represent that you are physically and mentally fit to participate, that you have disclosed any conditions that may affect your participation, and that you will follow facilitator instructions and any safety guidelines provided.

5. Release of Liability and Waiver of Claims

To the fullest extent permitted by law, you (on behalf of yourself, your heirs, executors, administrators, and assigns) release, waive, discharge, and covenant not to sue Om Arham Foundation Inc., its directors, officers, employees, facilitators, volunteers, agents, contractors, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, costs, or expenses of any kind, whether known or unknown, arising out of or related to your participation in any Program or use of the website, including without limitation claims based on:

  • Bodily injury, illness, emotional distress, or death;
  • Loss of, theft of, or damage to property;
  • The negligence of the Released Parties, to the extent permitted by applicable law;
  • The actions or omissions of other participants;
  • Information, instruction, or guidance provided in any Program.

This release does not apply to claims that cannot lawfully be released, including claims for gross negligence or willful misconduct, or claims that California law does not permit to be waived.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your participation in any Program, (b) your breach of these Terms, or (c) your violation of any law or the rights of any third party.

7. Code of Conduct

To support a safe and respectful environment, all participants agree to:

  • Treat facilitators, volunteers, and other participants with respect and dignity.
  • Refrain from disruptive, harassing, abusive, or unsafe behavior.
  • Comply with venue rules, safety instructions, and facilitator guidance.
  • Refrain from recording or photographing sessions without prior written permission.

We reserve the right to remove any participant who violates this Code of Conduct, without refund.

8. Payments, Donations, Refunds, and Cancellations

  • Fees for paid Programs are due at the time of registration unless otherwise stated.
  • Donations to Om Arham Foundation Inc. are tax-deductible to the extent allowed by law (IRC §170). Donations are non-refundable except where required by law.
  • For paid Programs, refund eligibility, deadlines, and any non-refundable portions will be specified at the time of registration. Where a refund policy is not separately specified, registration fees are non-refundable, but credits toward future Programs may be offered at our discretion.
  • We reserve the right to reschedule, modify, relocate, or cancel a Program. If we cancel a paid Program, you will be offered a refund or credit. We are not responsible for non-refundable travel, accommodation, or other third-party expenses you may incur.

9. Photography and Recording

By attending in-person or online Programs, you grant Om Arham Foundation a non-exclusive, royalty-free, perpetual license to use photographs, video, and audio recordings of you (in which you appear incidentally or as a participant) for educational, promotional, archival, and fundraising purposes. If you do not wish to be photographed or recorded, please notify the facilitator in advance and we will make reasonable efforts to accommodate your request.

10. Intellectual Property

All content on omarham.org and all Program materials — including text, graphics, logos, audio, video, curricula, and instructional content — are owned by or licensed to Om Arham Foundation and are protected by intellectual-property laws. You may use this content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written permission.

11. Website Use

  • You agree not to use the website for any unlawful purpose or in any manner that could damage, disable, or impair the website or interfere with another user’s use of it.
  • We may modify, suspend, or discontinue any aspect of the website at any time without notice.
  • The website is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the website and Programs are provided without warranty of any kind. Om Arham Foundation does not warrant that the website will be uninterrupted or error-free, that defects will be corrected, or that any Program will produce specific results or outcomes.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall the Released Parties be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the website or participation in any Program. The aggregate liability of the Released Parties for any claim arising out of or related to these Terms or your participation in a Program shall not exceed the amount you paid (if any) to Om Arham Foundation in connection with the specific Program giving rise to the claim.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your participation in any Program shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be interpreted to give effect to the original intent to the maximum extent permitted by law.

16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when changes were last made. Continued use of the website or participation in our Programs after changes are posted constitutes acceptance of the updated Terms.
